The National and State Assemblies Tribunal sitting in kaduna had yesterday uphold the declaration made by the Independent National Electoral Commission, INEC, at the February, 2020 re-run election as ordered by the Court of Appeals for the Kaduna State House of Assembly in Sanga that Hon. Comfort Amwe of the PDP was the winner of the 2019 general election.
The Tribunal has a unanimous judgment delivered yesterday dismissed in its entirety the petition filed by Hon. Haliru of APC challenging the Return of Hon. Comfort Amwe as the duly elected member of the Kaduna State House of Assembly representing Sanga State constituency.
It will be recalled that Hon. Haliru and APC approached the Tribunal seeking for the nullification of the election of Hon. Comfort Amwe of the PDP on two grounds, namely that the election was invalid by reason of non compliance of the Electoral Act, 2010(as amended) or corrupt malpractices (2) that the Respondents did not get the majority of lawful votes cast at the election.
In it’s well considered judgment which lasted about 5 hours, the Tribunal rejected the submissions of I. K. Bawa, SAN lead counsel for the Petitioners and upheld the submissions of Samuel Atung, Esq for the 2nd & 3rd Respondents and Halima Gachi, Esq for the 1st Responders.
In the final analysis, the Tribunal found that the Petition is bereft of any merit and accordingly dismissed same. The Tribunal also consequently ordered Hon. Haliru and the APC to pay Hon. Comfort Amwe and the PDP the sum #100,000 each as damages.
Speaking to Gurara Accord after her victory at the Tribunal at her resident in kaduna, Amwe thanked God for the victory and she praised the Tribunal for it’s professionalism and for been the last hope of the common man. She also appreciate her teeming supporters that their unalloyed loyalty has always been her strength. She said God will reward everyone for ensuring her victory both at polls and at the Tribunal.
