The tribunal sitting in Bida Road, kaduna had it’s second hearing into the petition filed by Mr. Haliru Gambo Dangana of the All Progressive Congress, APC, challenging the 25th January, 2020 rerun victory of Mrs. Comfort Amwe of the People’s Democratic Party, PDP, as declared by the Independent National Electoral Commission, INEC.
The rerun election was conducted pursuant to the judgement of the Court of Appeal delivered in November, 2019. The judgement directed the electoral umpire to conduct fresh election in 14 polling units of Sanga state constituency of Kaduna state.
INEC conducted the election and certified Amwe as the winner, having scored a majority votes cast at the election and satisfied all the conditions as contained in Electoral Act, 2010(as amended) and INEC guidelines made pursuant thereto.
However, in his petition, Dangana is claiming that election was not conducted in Gwantu 3 polling units and that the election result for Amar Lada polling unit for 2019 general election before the computation of the final results of 25th January, 2020 rerun election.
Adding that, documents tendered before the tribunal clearly reveals that the election result for Amar Lada polling unit for the 2019 general election was nullified at Ninzam South Ward at the instance of the Agents of the selfsame Haliru Dàngana. It now behoves on him(Haliru Dàngana) as petitioner to prove/establish the veracity of his claim.
At the pre-hearing on Monday, Counsels to Mrs. Comfort Amwe and Mr. Haliru Dàngana, Barr. Sam Atung and Barr. Abdul Mohammed respectively, tendered documents before the tribunal and which documents were admitted as exhibits and accordingly marked as such.
Further hearing into the matter have been adjourned to Wednesday, 29th April, for the issuance of the pretrial report which will the coast for the hearing of the substantive petition.
