The Court of Appeal sitting in Kaduna Division being a terminal Court on the subject matter has put to rest with absolute finality the issue of representation of Sanga constituency in the Kaduna State House of Assembly, KSHA.
The Court upholds the verdict of the National and State Houses of Assembly Election Tribunal which upheld the return of Hon. Comfort Amwe by the Independent National Electoral Commission, INEC, as the duly elected member of KSHA representing Sanga constituency.
It will be recalled that immediately after the Court ordered the re-run election and the subsequent return of Hon. Amwe of the PDP as the winner thereof, Hon. Haliru Gambo of the APC approached the Election Tribunal to nullify the return of Hon. Amwe of the PDP on the twin grounds that no re- election was held at Gwantu 3 polling unit and that the election results for Amar Lada polling unit ought to have been deducted from the votes tally of both candidates before the addition of the total votes of the candidates after the re- run.
However, the Election Tribunal in a considered judgment delivered on 6/8/2020 dismissed the petition. Whereupon, Hon. Haliru and his party approached the Court of Appeal by filing 6 grounds of appeal.
In his comments after the judgment of the Court of Appeal, Counsel to Hon. Amwe, Barr. Sam Atung lauds the judgment of the Court and posited that the judiciary has indeed lived up to historical role as the last hope of the common man and constitutional role as the guardian of our democracy.
